Recently we managed to resolve a complex and confusing situation. In 2017, rental income was received.
The tenant was a legal entity, and this legal entity was supposed to pay rental payments.
But due to financial difficulties, the director of this company began paying rent in his own name, i.e., as a private individual.
In the first case (if a legal entity), the tenant pays tax on rental income. The company pays 10% to the budget and transfers 90% to the apartment owner.
In the second case (if a private individual), the owner receives all 100%, and must pay the tax themselves.
Our client had a dispute with the tax authority about how to correctly calculate the income amount and what tax to pay.
Thanks to our assistance and proper document preparation, we managed to prove that REGARDLESS of who paid the rent, in this case the company was supposed to pay the tax.
Thus, the apartment owner, our client, owes nothing to the state. We provided clarifications and received confirmation that everything is in order.
