New Rules for Extending Residence Permits for Minor Children

In April 2017, new rules came into force regarding the extension of residence permits for minor children.

These amendments apply to children who obtained a residence permit in Latvia together with their parents and were minors at the time of obtaining the residence permit.

Since amendments to the Immigration Law were introduced, which created opportunities to obtain a residence permit for investors (for example, based on the purchase of real estate in Latvia), 7 years have passed, and many children of investors have reached adulthood. Under the previous version of the law, adult children lost their residence permit obtained together with their parents when they turned 18.

According to the new rules, if at the time of the repeated five-year extension of the residence permit by the parents, the child has not yet reached 18 years old, but for example is only 17 years old, then the child has the right to obtain a residence permit for a period of 5 years, i.e., until the age of 22.

If the child has already turned 18, but is not married, i.e., by default lives together with the parents, they also have their residence permit extended together with the parents for 5 years, regardless of their age.

Children over 18 years of age who are married lose the right to extend their residence permit together with their parents.
